The Law Office of Benjamin R. Levinson represents lenders who seek to obtain a court ordered Judicial Foreclosure of the real property and to obtain a deficiency judgment for money damages against the borrower and/or guarantor due to Judicial Foreclosure of the property being insufficient to pay the debt. Actions undertaken include:

  1. Preparation and filing of a Summons and Complaint for Judicial Foreclosure in the county where the property is located;

  2. Recording a lis pendens to protect the lender from later encumbrances;

  3. Seeking summary judgment if appropriate or conducting a trial of the action;

  4. Obtaining entry of judgment of foreclosure and order of sale of the real property;

  5. Obtaining a writ of sale;

  6. Timely filing (within 3 months after the sale date), service and litigation of an application for fair value deficiency hearing;

  7. Preparation, filing and service of a Money Judgment for the deficiency amount ordered by the Court.
