The Law Office of Benjamin R. Levinson
represents secured creditors in all bankruptcy chapters (generally 7,
11, and 13) throughout all four Bankruptcy Court Districts in the State
of California. Actions undertaken on behalf of lenders include the following:
- Obtaining relief from the automatic stay to allow the creditor to
foreclose and obtain possession of the real property collateral;
- Preparing, filing and litigating objections to Chapter 13 plans
of reorganization;
- Preparing and filing proofs of claim on behalf of creditors;
- Reviewing disclosure statements and plans of reorganization in
Chapter 11 and litigating objections to those disclosure statements
and Chapter 11 plans to protect the interests of the creditor from
cramdowns by the Debtor;
- Preparing, filing, and litigating applications for or in opposition
to use of cash collateral (rents) by a Debtor who owns income-producing
property;
- Preparing, filing and litigating motions to dismiss or convert
chapter proceedings for failure to comply with sections of the Bankruptcy
Code;
- Defense of lien avoidance actions and other adversary proceedings;
- Defense of objections to creditor's proof of claim brought by Debtors;
- Filing non-dischargeability actions to keep a creditor's debt from
being discharged through bankruptcy;
- Representation of creditors defending appeals to the Bankruptcy Appellate
Panel, the District Court, and the Ninth Circuit Court of Appeals.
